A Statement by the Asian Human Rights Commission

INDIA: Test of honesty for the country's judiciary or anode on its demise

The contempt of court proceedings initiated against Advocate Prashant Bhushan in the Supreme Court of India for the allegations he made against some of the former Chief Justices of the country will test the maturity of India's judicial system and that of its democratic framework. Indeed the Court has a statutory right to initiate proceedings against anyone, suo moto or through a petition presented before it. So have Prashant, and every other citizen in the country, a right to express their opinion of what they believe is to be true. Unfortunately, the tainted image of the Indian judiciary is one among them, whether the judges like it or not.

In an interview with Tehelka magazine, published on 5 September 2010, Prashant alleged, "… that out of the last 16 to 17 Chief Justices, half have been corrupt". Through an Amicus Curiae petition filed by a lawyer, Mr Harish Salve, the Supreme Court of India issued a notice to Prashant asking him to show cause why his statement and opinion should not be treated as 'contempt of court'.

Prashant's affidavit filed in reply to the contempt proceedings reiterate, explain and further name some of the 'tainted' judges. All of those who have been named, to clear their name if they can, must undergo a thorough investigation and a public trial by an impartial tribunal. Indeed it is to be seen whether the Indian judiciary or any other democratic institution worthy of its salt and name (as democratic) will be willing to take this 'risk'.

Prashant's original opinion further reiterated and explained in his affidavit is nothing but a detailed narration of the reasons why the average Indian fear that the country's judiciary, in particular, its Apex Court, has become unworthy of the maxim it claims to uphold, 'Yaddo Dharmastho Jayah', the Devanagari equivalent of fiat justitiaruat Caelum. Indeed Prashant being a lawyer is privileged to possess 'written, documentary and oral' evidence to substantiate his apprehensions that the Aam Admi (ordinary person), who face the worst brunt, should the judiciary of the country, the working for which his tax money is used is indeed corrupt.

Judiciary's negation of every attempt to bring 'fresh air and light into (its) dark and dusty corridors of power' has become its deplorable character during the past decade. By preventing all attempts to bring transparency in the functioning of the court, ranging from the question of appointment of judges to the applicability of the Right to Information Act, 2005, the Indian judiciary has behaved in such fashion as if it has indeed embarrassing things to hide behind its elevated dais where the most paid and immune jurists in the largest democracy of the world are seated. These attempts have reduced the Indian judiciary into despicable situations where on one occasion it had a serving judge, transferred and later elevated to the Apex Court while unambiguous allegations of material corruption were made against him based on which there were an audit objection and an impeachment proceeding. The Supreme Court also had the unique opportunity to direct its own Registrar to file an appeal against the order of a subordinate court, the Delhi High Court, in the Supreme Court, so that it could affirm the absoluteness of its impunity against public accountability at the expense of the taxpayer's money.

The Court has also the record of 'legally and fatally injuring' everyone who dared to suggest that the 'king is naked' using its sword of Contempt of Courts Act, 1971. This law, based on a medieval mental framework, has no place in a democracy, like a judiciary that despises transparency and decries accountability.

The allegation Prashant has made is just not an Indian issue. For instance a former Chief Justice of India, Mr A. M. Ahmedi was nominated to serve in international committees. He was appointed to look into human rights violations in East Timor by the United Nations, to assist the judiciary in Liberia by the International Court of Justice, and has been requested to review the state of relations between the judiciary, the legal profession and the executive and violation of human rights in Zimbabwe by the International Bar Association. Any argument that Ahmedi would do justice to the victims of human rights violations in foreign lands, while he has allegedly robbed the same for sheer self-interest and greed from his countrymen (and women) does not hold water. Ahmedi's case is just one among many that must be investigated.

It is often said that making public statements of the above nature against the judiciary of a country is immature. Some may ask, will such statements help in sorting out the mess that has now surfaced? Is it not amateur and nonprofessional to say these things in such an emphatic tone? The Asian Human Rights Commission (AHRC) believes that the professionalism of the civil society is demonstrated in its ability to raise timely questions of rule of law, with an expectation that it would generate a worthy public debate in the country where it is engaged.

Unfortunately, most of India's media are observing their characteristic silence on the issue. They have apparently perfected their art of stirring public opinion for the wrong cause using all the wrong methods, as they demonstrated in dealing with the parliament attack case, where they proved the case against the 'suspects', parroting the confession statement of the accused, extracted by some of the dreaded criminals wearing police uniforms, who practised some of the most inhuman methods upon the accused, including torture. Indeed the Indian judiciary convicted the accused, despite the prosecution failing to prove their case, an act by which the judiciary too reiterated that pride and speculation rules above justice.

The AHRC supports and congratulates Prashant Bhushan for the bold initiative that he has taken by calling for openness and transparency in one of the most immune public institutions of the world. It is now the responsibility of India's civil society to wake up from its slumber and augment this process of fastening public accountability to one of India's oldest constitutional institutions. It is the primary responsibility of the lawyers and judges who believe in the rule of law and democracy to publically support the process Prashant has initiated.

The AHRC requests everyone to sign an online petition created for the purpose.

To say the least, if the allegations made by Prashant do not lead into an impartial, prompt and public investigation, it has to be believed that democracy is dead in India.

नए साल के पुराने अनुभव [HAPPY NEW YEAR 2019 -31122018]........................................................................43

"LIFE BEGINS HERE AGAIN "✍



कभी मैं तो कभी वक्त , मुझ से जीत गया
और इसी खेल में एक साल और बीत गया
चारो और कोलाहल मचा है  घर में एक जवां बुजर्ग लाठी सहारे ,

कमर को थामे खड़ा है। पत्नी की आँखों में भी समुन्द्र लहराया है ,
मेहमानो को देख अंदाज़ा है मेरा , शायद कोई त्यौहार आया है। 
दोनों  के जेहन में एक ही ख्याल उबाल ले रहा है , कि

 खतरे  के निशान से ऊपर बह रहा है  ,उम्र का पानी...

वक़्त की मूसलाधार बरसात है कि    ,थमने का नाम नहीं ले  रही...

अकेलापन बढ़ा  इतना कि खुद को खुद का अहसास भी नहीं रहा
 किसी को फुर्सत कहाँ , जो हमारी तरफ  झांक भी सके

शायद 31 दिसंबर का  जश्न सब को मदहोश किये था

आज दिल कर रहा था, बच्चों की तरह रूठ ही जाऊँ,
और ..             अहसास करा दूँ अपनी मौजूदगी का

पर फिर सोचा,

उम्र का तकाज़ा है,मनायेगा कौन... हर कोई  नसीयत देने लगता है
आपको पता है घर में नए साल की पार्टी है , बड़े बड़े मेहमान आये हैं
आप सो जाओ दरवाज़ा बंद करके , कुछ चाहिये तो बेल्ल बजा देना


अब हमारे रिश्तों के बीच भी एक कॉल बेल्ल ही बची है , संवाद के लिए

भाई रखा करो नजदीकियां,   ज़िन्दगी का कुछ भरोसा नहीं...

फिर मत कहना  ,चले भी गए और बताया भी नहीं...

तुम्हारी कॉल बेल्ल हमारी दिल की हालत न बता पायेगी ,
उठने की हिम्मत न होगी तो , बेल्ल को दबाएगा कौन ?
यह भी तो बता के जाते मुझे

चाहे जिधर से गुज़रिये, मीठी सी हलचल मचा दीजिये...


उम्र का हरेक दौर मज़ेदार है, आज जहाँ तुम हो

कल हम वहां के ठेकेदार थे , आज  हम हैं जहाँ
कल होओगे  तुम भी वहां , फर्क सिर्फ इतना है , हम परिवार के साथ थे
और यहाँ परिवार आपके साथ है ,  जाएये सब कुछ नया साल मनाईये
अपनी उम्र का मज़ा लिजिये...



देखी जो नब्ज मेरी,  हँस कर बोला वो हकीम :  "जा जमा ले महफिल पुराने दोस्तों के साथ,


तेरे हर मर्ज की दवा वही है   दोस्तो से रिश्ता रखा करो जनाब...  ये वो हक़ीम हैं


जो अल्फ़ाज़ से इलाज कर दिया करते हैं।  खींच कर उतार देते हैं उम्र की चादर,


ये ही हैं वोह कम्बख्त दोस्त..  जो कभी बूढ़ा  होने नहीं  देते।

ताने मार मार कर कभी रुला कर , कभी शिक़वाए इजहार करके ,
कुछ भी हो इनको खोना नहीं , इस उम्र में नए दोस्त नहीं बना करते ,

बच्चे वसीयत पूछते हैं   रिश्ते हैसियत पूछते हैं,

लेकिन वो दोस्त ही हैं जो  आपकी टांग भी खींचते हैं ,
जरूरत में आपकी खैरियत भी  पूछते हैं....

                                *भाग्य* 




बचपन कितना अच्छा था हमारा 

, घडी सिर्फ पापा के पास थी और
वक़्त हमारे पास,
मेहनत माँ बाप करते थे और किस्मत हमारे पास

बड़े अदबो आदर से आज मैं अपने अदबी संगम के साथिओं के समक्ष अपनी जीवन की किताब का एक ऐसा अधाय्य लेकर आया हूँ जिसमे मैंने बड़ी मेहनत से सालों की खोज और अपने सामने घटित घटनाओं को शामिल किया है , मेरा यह मानना है की इंसान अपने जीवन में हर रोज अगर सिर्फ उसी दिन का लेखा झोका एक पेज पर संक्षिप्त में लिखे तो एक महीने में वह तीस पेज लिख डालेगा , और एक साल में 365 पेज , और उसे मैं अपनी उम्र 71 से गुना करूँ तो

365 X 71 =25915 . अगर २०० पेज की भी एक किताब हो तो कम से कम 150 पेपर बैक किताबें तैयार हो जाएँगी लेकिन पढ़ी वही जाएँगी जिसमे कुछ ऐसा हो जो लोगों को प्रेरणा दे और उनके दिल को छुए ,आज मैंने चुना है डेस्टिनी को यह ऐसा विषय है जो सबको कभी न कभी बहुत छु जाता है। आशा है आप

इसे ध्यान से सुन कर मुझे बताएँगे की मेरी बातो
से आप कितने सहमत हुए और डेस्टिनी ने आपके जीवन में आज तक क्या क्या गुल खिलाये है ?

किस्मत का हर फुल कभी खिलता ही नही
हर कदम साथ कोई कभी चलता ही नही....!
ये तो दस्तुर है सेहर-ए-मोहब्बत का
जिसे ज्यादा चाहो वो कभी मिलता ही नही....!!

जो किस्मत जिसे हम डेस्टिनी के नाम से भी जानते है हमे अपने माँ बाप से ही तो मिली है आज हम उनका कितना तिरस्कार करते हैं कितना इतराते है खुद पर अहंकार में की यह तो मेरी मेहनत है ,बे शरमी की हदों को पार करते हुए कभी कभी औलाद को माँ बाप को कोसते हुए भी देखा जाता है " आप ने हमारे लिए किया ही क्या है ? आप के जमाने में यह हार्ड लाइफ कहाँ थी आपको क्या पता जो गुग्गल बाबा को पता है. ? वगैरह वगैरह।

पर हमें नहीं भूलना चाहिए की जो आज हम है उसके पीछे है हमारी कई पीढ़ियों की विरासत जिसमे हमारी हर पीढ़ी के genes /sanskaars में बड़ी जबरदस्त तरीके से बदलाव हो रहा है जिसे mutation कहा जाता है। 


 इतनी सूचनाएं हमारे शरीर के प्र्तेक कोशिकाओं यानी की जेनेटिक सेल्स में stored जो पीढ़ी दर पीढ़ी Automatically हमारे शरीर की हर कोशिका याने की cells में जमा हो रही है और पूरी की पूरी आने वाले बच्चे के जींस में transfer हो रही है , दोनों परिवारों की लड़की के पारिवारिक genetic characters और ladke के parivaar के जेनेटिक characters दोनों के composit और hybrid , हर नए पैदा होने वाले बच्चे में दो तरह के संस्कार होंगे एक वह जो उसके विरासत यानी genes से मिलेंगे और दुसरे उसके अपने कर्म , संगत ,education से प्रभावित होंगे जो उसकी डेस्टिनी /किस्मत निर्धारित करेंगे।
भारत के प्रसिद्ध डॉ हरगोविंद खुराना को इसी genome थ्योरी के लिए कुछ वर्ष पहले नोबल प्राइज मिला था , यह थी आधुनिक विज्ञान की पहली कोशिश किस्मत यानी डेस्टिनी को डिकोड करने की कोशिश , और आज इसका भरपूर इश्तेमाल मेडिकल साइंस, एग्रीकल्चर ,genetically modified crops in other words इंसान अपने साथ साथ पेड़ पोधे पशु पक्षिओं के genome में भी फेर बदल कर उनकी किस्मत ही बदलने में कामयाब हो गया है। 

इंसानो के इलाज़ में भी इस तकनीक का प्रयोग किया जा रहा है , इसी थ्योरी से बीमारी कोन्नेक्शन खोज लिया गया था की इंसान केसाथ कौन सी उम्र में क्या क्या होने वाला है और वह क्या क्या कर पायेगा। क्या नहीं करेगा , इसमें कौन कौन से genes aggressive हैं और कौन कौन से recessive जो की एक खास तरह के माहौल में एक्टिव होंगे और उसे कौन कोन  सी बीमारी लगेंगी , अगर सोये हुए संस्कार /genes को इंसान जगाने में सफल हो जाता है तो उसकी destiny बदलने लगती है. नहीं हुए तो इंसान उनका इस्तेमाल नहीं कर सकता। आज मेडिकल साइंस हार्ट , लंग्स , शरीर की ज्यादातर बिमारिओं को जेनेटिक मानते हैं और तभी बहुत सी बीमारियां अभी तक हमारी पकड़ से दूर हैं क्योंकि genetic science में बहुत कुछ किया जाना बाकी है और genes वश में अगर आ जायेंगे तो हम अपनी किस्मत भी अपनी मर्ज़ी से बदल सकेंगे।


PREDETERMINED end or end results of OUR efforts is the DESTINATION OF OUR LIFE, DERIVED from the Latin word Fatum means FATE, Destiny ends at the DESTINATION of life. In other words, what we do in our life or are still doing is towards fulfilling our commitment to a destination WHICH is already predetermined and governed by our INHERITED SANSKAARS or we may call it RNA and DNA in today's context. unless we work hard to effect a mutation and change the outcome of our destiny.

We are born to parents who either have been arranged into getting married or happened to be lovebirds who got married later with or without the consent of parents, who can forget the ordeal of Patri and Matching of characters or GUNS? 

Many of us sitting here would have passed through this scanning and time-consuming practice. where despite boy liking a girl were not allowed to marry because one of the two was either Manglik or their GANS did not match, I believe many of us sitting here would have either practised it in their life or have experienced it being followed by some in the society. what was the theory behind this Hindu practice?. 

in fact, it is very old Indian Vedic system of Horoscope matchmaking was either through astrology or Patri, as a must-follow rule for a happy married life and the calculation of giving a name to a newborn was also based on such calculations as to allow him or her a generic name so that his Raashi/ zodiac sign could be known merely knowing his/her name and it still continues in India without any significant deviations. The purpose behind all this was to provide a safe and sound destination to a journey ऑफ़ लाइफ? called Destiny.

Destiny is the keyword of one's journey of life the world over, we all accept and agree to the existence of Indian History of 10000 years or so including Vedic India of Ramayana and Mahabharata times. Ramsetu believed to be more than 6000 years old has recently been scientifically reconfirmed by our modern-day world Nature exploring Authorities Like NASA of the USA, A fact which Indian scriptures so vehemently supported and authenticated by our own saints. 

But why has it been denied all along so many centuries ? not given due importance, does it also go by some mysteries of Destiny? The answer is yes rule of myth is the cause and truth always wins over myth is the law of nature, but it takes time to unravel itself in the end, was destined to be so.

Destiny or the Bhagya Shastra had astounded me since my childhood, I have been watching and observing these Roadside Palm readers, astrologers with few old mutilated soiled books as if from some museums which were all greek to me but these Pandits could make something out of it by simply asking our name, date of birth, place of birth to predict so accurately which just amazed every one consulting them for just a meagre sum .people used to consult them for every problem in their life be it marriage, theft, childbirth, marriage, sickness death, these very important consultants of our times were called jyotishi in my small town of Rohtak in 1958 in Punjab but now a part of Haryana where My family had taken refuge after being pushed out of Pakistan during the Partition of India in 1947.

Such was the aggressive passion within me for Understanding destiny and predicting past or forthcoming events in one's life, that too accurately BUT was not that simple, it required a lot of

knowledge, the study of reference books and patience to decode lines on palms. instead of reading cartoon books or jassoosi novels which was the trend those days, I started spending my small pocket money on palmistry books and filmi songbooks of Mukesh, Kishore, Hemant Kumar, Mohammed Rafi, All published by Dehati Pustak Bhandar those days they were the prominent book publishers for the masses. 

I kept pursuing my interests in Palmistry and destiny readings, written by famous Authors of palmistry and astrology with dedication, cheerio was one such American author of palmistry who tried to use scientific /medical knowledge to define destiny. It revealed to me that destiny indicates the configuration of your HEART, LUNGS, LIVER, MIND, KIDNEYS, EYES, HANDS FEET and all other internal organs synchronised to help achieve your destination of life, failure of any one of them will derail your destiny or reduce the outcome.

there are fate lines sunlines and many more small supporting lines on both of our hands,

BUT MIND IT THESE LINES ARE JUST RECORDINGS OF STATUS OF OUR VITAL ORGANS AND NOT THE PREDICTIONS, PREDICTION IS BASED ON this FRAMEWORK OF LINES, THROUGH CALCULATIONS AND EXPERIENCE, WE CAN PREDICT WITH FAIR DEGREE OF ACCURACY BY EXPERIENCE THAT IF THE PERSON WITH PARTICULAR SET OF ASSETS OF LINES IS HEADING FOR SUCCESS OR FAILURE IN HIS /HER DESTINED discourse of LIFE

The whole study of the destiny of a person was the study of various body organs whose imprints are on our palms in the form of thick and fine lines some large and some small lines crisscrossing each other.

How destiny makes or mars a career is any body's guess, I was easily admitted into Medical college in 1967 to become an MBBS doctor, Professor Maini who was my mentor always appreciated me for my presence of mind and an excellent grasp of medical essentials but one day I fainted in the anatomy dissection class where dead bodies are dissected to teach students about various human organs including arteries veins and all sorts of bones, I even could not cope with the sight of blood while assisting senior doctors in an operation theatre, very sight of crying dying patients just pushed me to the walls, I seriously pondered and meditated to come out of this dilemma,
THEN I REALIZED AND ASKED MYSELF that even if I become a doctor will I be able to justify the demands of profession? but the inner voice warned me of my weaknesses, My heart was emotionally soft and making money from poor patients or befooling rich patients to go for surgery even if they did not require it, my heart and mind both revolted against this kind of money-making future. THIS WAS MY HEART AND MIND COUPLED WITH INNER CONSCIOUSNESS THAT CHANGED MY DESTINATION AND DESTINY DIVESTING ME OF MY AMBITION TO BECOME A DOCTOR WHICH OUSTED ME FROM NOT ONLY THE RACE OF MY CHOSEN LINE OF STATUS & SOCIAL DIGNITY BUT ALSO PUSHED TO ANOTHER SERIOUS PROFESSION OF A LAWYER?


Switching to the legal field WAS NEXT BEST OPTION AS IT USED TO BE A PROFESSION OF ANALYTICAL KIND OF PEOPLE WHO COULD THINK OUT OF THE BOX TO PROVE THEIR POINT OF VIEW, IT WAS SUGGESTED BY MY FATHER AS THEY WERE FACING LOT OF COURT CASES IN THEIR FACTORY AND MY FAMILY NEEDED A FULLTIME LAWYER TO DEFEND AND CONTEST LITIGATIONS GOING ON IN OUR FACTORY OR FAMILY AT THAT TIME.

SCIENCE GRADUATE WITH FAILED ASPIRATIONS OF A DOCTOR, TURNING TO LEGAL FIELD ? was just accidental and challenging as well, BUT here also I had to be selectively cautious about my own values, is a medical science student throughout my schooling and college, law studies seemed quite DIFFERENT AND boring. 

BUT MY MIND HELPED ME TO BECOME A SUCCESSFUL UNIVERSITY OF DELHI LAW GRADUATE and the environment in courts PROVED even worst, a lot of things had to be done against your own ethics, AND CONSCIENCE, saving criminals, rapists murderers and terrorists from punishment and feeding your family with the money earned from criminals just did not go well with me. 

THOUGH THERE were TONS OF MONEY TO BE MADE IN COURTS IF I WANTED TO FIGHT FOR THE VERY PEOPLE WHO ARE CULPRITS, KILLERS, WHO ARE REAL MENACE TO THE SOCIETY. MY CLASSMATES BECAME JUDGES, POLITICAL LAWYERS, MINISTERS AND MINTED HELL OF THE MONEY THROUGH COMPROMISING HUMAN VALUES, SO HERE ALSO I HAD TO TRAVERSE A PATH WHICH SUITED MY DESTINY, COURTS ALSO WORK UNDER POLITICAL BOSSES AND CORRUPTION CAN BE FATAL TO THE VERY PURPOSE OF JUSTICE WHICH WAS NOT ACCEPTABLE TO MY MIND, TO AVOID UNNECESSARY CONFRONTATIONS WITH JUDGES AND SPEAKING AGAINST THEM IN THE COURTS, 

 I deliberately concentrated only on corporate LITIGATIONS, Arbitration, trademarks and patents and the selective cases OF POOR AND DEPRIVED PEOPLE where I was convinced of the genuineness of a case . I made good money working honestly in areas of my choice with no liability on my heart and mind. THIS IS HOW I HAD FOUND MY DESTINY.

रात को पत्नी पति बिस्तर पर लेटे हुए हैं लेकिन आपस में कोई बात ही नहीं कर रहा , पत्नी मन ही मन में सोच रही है ;
(१)यह आज कल मुझ से ठीक बात क्यों नहीं कर रहे
क्या मैंने इनका लंच ठीक से पैक नहीं किया या सब्ज़ी स्वाद नहीं बनी थी
नहीं यह नहीं हो सकता सब्जी तो बिलकुल ठीक बनी थी मैंने भी खाई थी
फिर क्या वजह हो सकती है ? तो क्या मैं पहले जैसी खूबसूरत नहीं दिखती ? क्या मेरा मोटाप्पा ज्यादा तो नहीं बढ़ गया जो उनेह अच्छा ना लग रहा हो , शायद मेरे थके चेहरे पर झुर्रिया ज्यादा दिखाई दे रही है इनको तभी मेरी और देख भी नहीं रहे , या मेरी रोज रोज की किच किच से परेशान हो कर इनके जीवन में कोई दूसरी तो नहीं आ गई ?

पति को झकझोरते हुए कुछ तो बोलो न ,
यार अब क्या बोलूं मेरी तो खुद ही समझ में नहीं आ रहा , इन पांचो राज्यों में मोदी हार कैसे गया ,
पत्नी जी की हंसी अभी तक नहीं रुक रही है।
